PREAMBLE
These terms are entered into between, on the one hand, the company JV Entreprise Individuelle, registered with the RCS of Lille under the registration number 983 294 125, 53C Résidence Philippe de Girard 59113 Seclin, hereinafter referred to as « Gymbro Legacy » and, on the other hand, individuals wishing to make a purchase through The Gymbro Legacy website (gymbro-legacy.com), hereinafter referred to as « the user. »
1. SCOPE OF APPLICATION
1.1 These general conditions apply to any sale of products presented on Gymbro Legacy website.
1.2 You acknowledge that you have read, before sending your order, these General Sales Conditions and have been provided with all the information listed in Article L.221-5 of the Consumer Code in a clear and understandable manner. Confirming your order on The Gymbro Legacy website constitutes unconditional acceptance of these General Sales Conditions.
2. CONTRACT CONCLUSION
2.1 By placing an order, you declare that you are acting exclusively for private purposes. This contract is exclusively concluded in the French language.
2.2 The essential characteristics and price of our products are indicated on pages containing the detailed description of the products in the online store. The « confirm order » button allows you to confirm your order, making it final, and a sales contract is thus concluded. We will confirm the receipt of your order by email.
2.3 We reserve the right not to accept an order or to cancel an order if it has been placed using software, robots, collectors (web crawlers), indexing robots (web spiders), or an automated system or scripted behavior, of any kind, and by using third-party services to place an order on your behalf.
3. STOCK, PRICES, DELIVERY FEES
3.1 Products are invoiced based on the prices indicated in the offer at the time of the order. The prices indicated are final prices, all taxes included at the legal rate in force.
3.2 The prices of products displayed on The Gymbro Legacy do not include delivery fees. Depending on the amount of your order or the delivery method you have selected, delivery fees may be charged.
3.3 Upon delivery, you are required to immediately check if it is complete and if the merchandise is damaged. Any claims must be addressed promptly to the transport company. You must also ensure that the delivered goods match your order. In case of non-compliance of the goods with the order, you must inform our customer service by email at contact@gymbro-legacy.com.
4. PAYMENT
4.1 We accept the following payment methods: credit card and secure PayPal payment system. Depending on each order, we reserve the right not to offer certain payment methods or to offer others. We only accept payments from bank accounts held within the European Union (EU). All fees related to your payment are at your expense.
4.2 You agree to receive invoices and credit notes only in electronic form.
5. USE OF DISCOUNT VOUCHERS
5.1 Discount vouchers are only distributed free of charge as part of promotional activities. They have an expiration date, cannot be purchased, and are not transferable.
5.2 Discount coupons are valid only during the specified period and can be used only once in a single order. Some products may be excluded from the benefit of discount vouchers. A minimum purchase amount may be specified for each discount voucher.
5.3 To use a discount voucher, the order value must be at least equal to the voucher amount. The difference between the amount of the discount voucher and the price of your order can be paid by any means of payment offered. The credit represented by the discount voucher is not refundable and does not accrue interest. In case of total or partial return of the goods, the portion of the price paid by the discount voucher will not be refunded.
5.4 To apply a discount voucher to an order, you must enter the voucher code before sending the order. The application of discount vouchers to already sent orders is excluded. Unless otherwise stated, it is not possible to combine multiple discount vouchers.
5.5 If you used a discount voucher for your purchase, we reserve the right to charge you the unreduced price of the merchandise when, due to partial retraction, the total amount of the remaining order is less than or equal to the value of the discount voucher.
6. RIGHT OF WITHDRAWAL
6.1 The buyer has a withdrawal period of 14 clear days from the delivery of their order, which will be refunded upon return of the delivered products.

7. RETURN POLICY AND REFUND
7.1 Refunds are only offered to customers who receive incorrect or damaged items. If you are affected, please contact us at contact@gymbro-legacy.com, sending us photos of the damaged items, and we will take the necessary steps to refund you.
7.2 Issues justifying a return include:
- The product was printed incorrectly.
- The product was damaged (excluding damages during delivery).
- The product does not match the execution information (e.g., incorrect or improperly placed printed image, incorrect size, color, or type of product).
7.3 The Gymbro Legacy has the sole discretion to grant a refund (including the refund method), credit your account, or replace a printed product.
7.4 The Gymbro Legacy will not grant a refund, credit your account, or replace a printed product solely because the carrier failed to deliver or the delivery was delayed. In this case, you must attempt to resolve the delivery dispute directly with the carrier.

9. LEGAL WARRANTIES
Sales through The Gymbro Legacy website are subject to the conditions of the legal conformity warranty provided for in Articles L.217-4 and following of the Consumer Code, as well as the legal warranty for hidden defects provided for in Articles 1641 and following of the Civil Code.
Article L. 217-4 of the Consumer Code:
The seller delivers a good in conformity with the contract and is liable for defects of conformity existing at the time of delivery. He is also liable for defects of conformity resulting from packaging, assembly instructions, or installation when it was his responsibility under the contract or was carried out under his responsibility.
Article L. 217-5 of the Consumer Code:
The good is in conformity with the contract if it is fit for the usual expected use of a similar good and, if applicable:
- if it corresponds to the description given by the seller and has the qualities that the seller presented to the buyer in the form of a sample or model;
- if it has the qualities that a buyer can legitimately expect in view of public statements made by the seller, the producer, or his representative, particularly in advertising or labeling;
- or if it has the characteristics defined by mutual agreement between the parties or is suitable for any special use sought by the buyer, brought to the attention of the seller, and accepted by him.
Article L. 217-12 of the Consumer Code:
The action resulting from the lack of conformity is prescribed within two (2) years from the delivery of the good.
Article L. 217-16 of the Consumer Code:
When the buyer asks the seller, during the commercial guarantee period granted to him when acquiring or repairing a movable good, for a refurbishment covered by the guarantee, any period of immobilization of at least seven days is added to the duration of the guarantee that remained to run. This period runs from the buyer’s request for intervention or from the availability for repair of the item in question, if this availability is later than the request for intervention.
Article 1641 of the Civil Code:
The seller is liable for hidden defects in the sold item that render it unfit for the use for which it is intended, or which so diminish this use that the buyer would not have acquired it, or would have given it a lower price, if he had known them.
Article 1648 paragraph 1 of the Civil Code:
The action resulting from redhibitory defects must be brought by the purchaser within two years from the discovery of the defect.
10. OTHER INFORMATION
10.1 Each customer has the right to have only one account at a time on The Gymbro Legacy website. We reserve the right to delete multiple records.
11. DISPUTE RESOLUTION
Pursuant to Article L. 612-1 of the Consumer Code, « Every consumer has the right to resort free of charge to a consumer mediator for amicable resolution of the dispute that opposes him to a professional. » Disputes of a contractual nature, concerning the execution of a sales contract or the provision of services, between a consumer and a professional are covered. In case of difficulties, we invite you to contact our after-sales service beforehand (see point 11). If your problem is not resolved, you can use the services of a mediator within one (1) year from the receipt of your request by the after-sales service, for the out-of-court settlement of the dispute.
